1. Acceptance of Terms

Welcome to HourVibes, operated by HourVibes (entity formation pending) (“HourVibes,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the HourVibes website, mobile applications, and related services (collectively, the “Service”).

By accessing or using the Service, or by registering for an account, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not access or use the Service.

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS AND OBLIGATIONS, INCLUDING A LIMITATION OF LIABILITY, AN ASSUMPTION OF RISK FOR IN-PERSON MEETINGS, A BINDING ARBITRATION PROVISION, AND A CLASS-ACTION WAIVER.

These Terms may be updated at any time, effective upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Nature of the Service — What HourVibes Is and Is Not

HourVibes is a dating and social-introductions platform. The Service allows adult members to discover one another, communicate, and arrange to meet in person for dates and social companionship. Members may offer and accept compensation solely in exchange for a person's time, companionship, and the experience of a date or social meeting.

HourVibes is NOT, and may NOT be used as:

  • an escort service, or any service in which payment is offered, solicited, or accepted in exchange for sexual activity, physical intimacy, or any physical or sexual service of any kind;
  • a means to solicit, arrange, or engage in prostitution or any commercial sexual activity;
  • a platform for adult content, pornography, or sexually explicit material;
  • a means to traffic, exploit, or harm any person.

The compensation permitted on the Service is exclusively for a member's time and companionship on a lawful, non-sexual, non-physical basis. Any payment, offer, or expectation tied to sexual or physical services is strictly and absolutely prohibited, will result in immediate termination, and may be reported to law enforcement.

You acknowledge and agree that HourVibes acts solely as a venue and technology platform that connects members. We are not a party to, and assume no responsibility for, any meeting, interaction, agreement, or arrangement between members.

3. Eligibility

To use the Service, you represent and warrant that:

  • you are at least eighteen (18) years of age (or the age of majority in your jurisdiction, if higher);
  • you have never been convicted of a felony, and have never been convicted of any crime involving violence, sexual misconduct, fraud, or harassment;
  • you have never been required to register as a sex offender in any jurisdiction;
  • you are not located in, and will not use the Service from, any jurisdiction where the Service is prohibited by law;
  • you have not previously been removed, suspended, or banned from the Service;
  • you have the legal capacity and authority to enter into these Terms.

We reserve the right (but assume no obligation) to verify any of the foregoing, including through identity verification and screening of public records, and to refuse, suspend, or terminate access to anyone at our sole discretion.

4. Account Registration and Security

You agree to provide accurate, current, and complete information during registration and to keep it updated. You are responsible for safeguarding your login credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. We are not liable for losses arising from your failure to secure your account.

You may not create an account using another person's identity, create more than one account without our permission, or transfer or sell your account.

5. Identity Verification

To promote member safety, we may require identity verification (including government-ID verification) for some or all members as a condition of using the Service. However, you acknowledge and agree that we do not guarantee the identity, age, background, conduct, or intentions of any member. Verification, where performed, reduces but does not eliminate risk. See Sections 9 and 11.

6. Prohibited Conduct

You agree that you will not, and will not assist or permit any third party to:

  • offer, solicit, request, or accept payment or anything of value in exchange for sexual activity, physical intimacy, or any physical or sexual service;
  • use the Service to engage in, arrange, or facilitate prostitution, commercial sexual activity, human trafficking, or any other illegal activity;
  • post, transmit, or share any nude, sexually explicit, sexually suggestive, or pornographic content;
  • harass, threaten, stalk, abuse, defame, intimidate, or harm any member or any HourVibes personnel;
  • solicit members for unrelated commercial purposes, advertising, spam, or to sell goods or services outside the permitted use of the Service;
  • misrepresent your identity, age, photographs, or intentions, or impersonate any person or entity;
  • collect, harvest, or scrape members' personal data or any content from the Service by automated or other means;
  • use bots, scripts, or automated tools to access or interact with the Service;
  • circumvent, disable, or interfere with security features or the proper functioning of the Service;
  • use the Service in violation of any applicable law, rule, or regulation;
  • encourage, induce, or solicit any other member to engage in any of the foregoing.

Violation of any provision of this Section may result in immediate termination and, where appropriate, referral to law enforcement. We expressly reserve the right to cooperate fully with law enforcement and to disclose member information as required by law or as we deem necessary to prevent harm.

7. Member Conduct, Meetings, and Assumption of Risk

You are solely responsible for your interactions with other members, including any decision to meet in person. HourVibes does not conduct comprehensive background checks except as expressly stated, and cannot and does not guarantee the conduct, identity, or safety of any member.

YOU ASSUME ALL RISK ASSOCIATED WITH MEETING OTHER MEMBERS IN PERSON.

You agree to take reasonable safety precautions, including but not limited to:

  • always meeting in a public place;
  • never meeting at a private residence or isolated location, particularly for a first meeting;
  • telling a friend or family member where you are going, with whom, and when you expect to return;
  • keeping a charged phone and means of independent transportation;
  • not sharing sensitive personal information (home address, financial details, government identifiers);
  • trusting your instincts and leaving any situation in which you feel unsafe;
  • declining and reporting any member who proposes, requests, or implies any sexual or physical exchange for payment, or who otherwise makes you uncomfortable.

If a member behaves in a manner that violates these Terms or makes you feel unsafe, report it to us immediately at support@hourvibes.com and, where appropriate, to law enforcement.

You acknowledge and agree that HourVibes is not a party to any meeting or arrangement between members and is not responsible or liable for the acts or omissions of any member, including without limitation any physical injury, death, emotional distress, property damage, fraud, harassment, or other harm. See Section 11.

8. Payments, Compensation, and Refunds

a. Permitted compensation. Members may agree, through the Service, on compensation for a date or social meeting consisting solely of a member's time and companionship, consistent with Section 2. All such payments must be made through the Service's payment system. Arranging payment outside the Service to circumvent these Terms is prohibited.

b. Processing. Payments are processed through our third-party payment processor(s). By making or receiving payments, you agree to the applicable processor's terms. We may charge a service fee, disclosed at the time of the transaction.

c. Authorization. You authorize us and our processor to charge your selected payment method for all amounts due, including service fees and applicable taxes.

d. Refunds and cancellations. HourVibes currently offers a buyer-friendly refund policy:

  • Provider no-show. If a member who agreed to attend a booked meeting fails to appear, the paying member receives a full refund, including any HourVibes service fee.
  • Cancellation by the paying member. If the paying member cancels a booking before the meeting takes place, they receive a full refund, including any service fee.
  • Cancellation by the attending member. If the member who agreed to attend cancels before the meeting, the paying member receives a full refund, including any service fee.
  • Dissatisfaction with a completed meeting. If a meeting takes place but the paying member is dissatisfied, they may submit a dispute to HourVibes. We will investigate the circumstances, and where we determine there is reasonable cause for a refund, we will offer a full refund.
  • Safety or Terms violations. If a meeting is cancelled, ended early, or does not proceed because a member violated these Terms (including any conduct prohibited under Sections 6 or 7), the paying member receives a full refund, and the violating member's account may be suspended or terminated.
  • Service fees. HourVibes service fees are included in all refunds described above; we do not currently retain our fee on refunded transactions.
  • How refunds are issued. Refunds are returned to the original payment method and may take 5–10 business days to appear, depending on your payment provider.
  • Chargebacks. Please contact us at support@hourvibes.com to resolve any billing concern before initiating a chargeback, as nearly all good-faith concerns are eligible for a refund under this policy.

HourVibes reserves the right to modify this refund policy prospectively; the policy in effect at the time of your booking governs that booking.

e. Taxes. Members are solely responsible for any taxes arising from compensation received through the Service. Members receiving compensation are independent parties, not employees or agents of HourVibes (see Section 13), and are responsible for their own tax reporting.

f. Chargebacks. Fraudulent chargebacks may result in account termination and collection action.

9. No Endorsement; No Background Checks

Except for any verification expressly described in Section 5, HourVibes does not conduct criminal background checks, credit checks, or other comprehensive screening of members. We do not endorse, recommend, or vouch for any member. Any reliance you place on member profiles or representations is at your own risk. It is solely your responsibility to take precautions to protect yourself.

10. Content and Licenses

You retain ownership of content you submit (“Your Content”), but grant HourVibes a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and distribute Your Content as necessary to operate and promote the Service. You represent that you own or have the rights to Your Content and that it does not violate these Terms or any third party's rights.

We may, but are not obligated to, monitor, review, or remove any content at our sole discretion. We do not guarantee that objectionable content will be removed promptly or at all.

Photo standards: All profile photos must depict the account holder, must clearly show the member's face for at least one photo, and must not contain nude, sexually explicit, or sexually suggestive content.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOURVIBES AND ITS OFFICERS, OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY PHYSICAL INJURY, DEATH, EMOTIONAL DISTRESS, PROPERTY DAMAGE, OR OTHER HARM, ARISING OUT OF OR RELATING TO (A) YOUR USE OF THE SERVICE, (B) ANY INTERACTION OR MEETING WITH ANOTHER MEMBER, OR (C) THE CONDUCT OF ANY MEMBER, WHETHER ONLINE OR OFFLINE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

YOU AGREE THAT HOURVIBES HAS NO LIABILITY FOR ANY DISPUTE BETWEEN YOU AND ANY OTHER MEMBER.

IN ALL CASES, HOURVIBES'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (I) $100 OR (II) THE TOTAL FEES YOU PAID TO HOURVIBES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations; in such jurisdictions liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless HourVibes and its officers, owners, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your breach of these Terms; (c) your interactions or meetings with any member; or (d) your violation of any law or any third party's rights.

13. No Employment or Agency Relationship

Members who receive compensation through the Service are independent individuals, not employees, agents, partners, or contractors of HourVibes. Nothing in these Terms creates any employment, agency, partnership, or joint-venture relationship between you and HourVibes.

14. Termination

We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. You may terminate your account at any time by contacting us at support@hourvibes.com. Provisions that by their nature should survive termination (including Sections 6, 7, 11, 12, and 15) shall survive.

15. Dispute Resolution; Governing Law

We want to resolve any concern you have quickly and fairly. If you have a dispute with HourVibes, please first contact us at support@hourvibes.com so we can try to resolve it directly.

HourVibes is in the process of finalizing its formal dispute-resolution terms, including arbitration and governing-law provisions, in consultation with legal counsel. Until those terms are published, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be handled on a good-faith, individual basis between you and HourVibes, and will be governed by the laws of the United States and the state in which HourVibes is established, without regard to conflict-of-law principles. Updated dispute-resolution terms will be posted here when available, and your continued use of the Service after they are posted will constitute acceptance of them.

Nothing in this section limits any rights you may have that cannot be waived under applicable law.
